Civil Law

Civil Law is the branch of law that regulates disputes between individuals (‘citizens’). It is part of Private Law. In Greece, it is regulated by the Civil Code and is divided into five parts.

  • The General Principles of Civil Law: This part includes general definitions that concern all Civil Law, such as what is a natural and legal person, what is a declaration of intent and legal action, how and when a contract is validly formed (proposal, acceptance, etc.), what are the consequences of defects in intent (mistake, fraud, duress), etc.
  • The Law of Obligations regulates liabilities, meaning the legal relationships based on which a person owes a provision to another. The two main subjects are obligations arising from contract and obligations arising from the law. Civil Law regulates the rights and obligations of the debtor and creditor of a provision, the abnormal evolution of an obligation (inability to provide, delay, defective performance by the debtor), specific contracts, and torts.
  • Property Law regulates absolute rights over things, such as ownership, possession, usufruct, easements, mortgages, and pledges. Property Law defines what these rights are, what content they have, how they are established, transferred, and protected.
  • Family Law regulates matters related to marriage, the obligations and rights of spouses, divorce, parental custody of children, the rights and obligations of parents and children, adoption, and matters regarding alimony between spouses and relatives.
  • Inheritance Law regulates matters concerning inheritance succession, wills, inheritance induction to heirs, legitimate portion, etc.
